Justice Olanrewaju Mabekoje of the Ogun State High Court sitting in Abeokuta has quashed the 43 count charge brought against the former governor of the state, Otunba Gbenga Daniel saying that the Economic and Financial Crimes Commission (EFCC) failed to seek the prayer of the court before filling the information that contained the indictable offences proffered against Daniel.

The EFCC had dragged Daniel before the court over allegations bothering on stealing, fraudulent conversion of Local Government funds, failure to declare assets and conversion of state government landed properties for personal use.

While reading his ruling on the matter, Justice Mabekoje said the EFCC as a prosecuting agency committed a fundamental error for not seeking the leave of the court before filling the charges containing the indictable offences.

Counsel to the EFCC, Mr Rotimi Jacobs however said the judgement was only a temporary setback as the commission would be back in court to put the records straight.

Gbenga Daniel’s counsel, Professor Taiwo Osipitan branded the judgment as a welcome development.
